Terms and Conditions

1. scope
The following general terms and conditions apply to all orders sent to us electronically, by telephone, letter or e-mail and are automatically recognized with every order. Your order will be processed according to the terms and conditions valid at the time of the order. You can find our current terms and conditions on our website at www.fragility.de/pages/agb
Deviating, conflicting or supplementary terms and conditions do not become part of the contract unless their validity is expressly agreed in writing. The customer's formal reference to terms and conditions is expressly contradicted.

2. conclusion of contract
The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding online catalogue. By clicking the "Send order" button, you place a binding order for the goods contained in the shopping cart. The receipt of your order is confirmed together with the acceptance of the order immediately after it has been sent by automated e-mail. With this e-mail confirmation, the purchase contract has come about.

3. Prices
The prices quoted are in EURO and include the statutory value-added tax. In addition to the purchase price, shipping costs and, depending on the payment option, fees also apply to an order. Technical changes as well as changes in shape, color and/or weight are reserved within reasonable limits. A minimum order value of EUR 30.00 plus shipping costs applies per order. We take no responsibility for the accuracy of this information. With regard to the type and scope of the delivery, only the information contained in the order confirmation is decisive. An obviously incorrect price is not legally binding for us, the seller. Valid for orders from Germany and abroad.

4. delivery
Unless otherwise agreed, delivery will be made from stock to the delivery address you specified. If the goods are available immediately, the delivery time is 1-3 working days. The shipping costs are EUR 4.99 plus the fees due depending on the payment option. The risk during shipping is transferred to the sender, even in the case of partial deliveries, as soon as the delivery has been handed over to the sender (DHL) by us or one of our agents. For orders from abroad, different shipping costs apply depending on the country.

5. right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

Inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample revocation form for this, but this is not mandatory.

You can fill out and submit the model cancellation form or any other clear statement. If you make use of this option, we will immediately (e.g. by e-mail) send you confirmation of receipt of such a revocation.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you revoke this contract, we have to repay all payments that we have received from you, excluding delivery costs (), immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract has been received For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You have to send the goods to rosch.arslan@outlook.de.com or to Sahin Arslan, Kocherweg 22, 74172 Neckarsulm to be returned or handed over. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of cancellation policy.
The cancellation form is in the shipping box. This will be sent to rosch.arslan@outlook.de and you will be informed of an answer as soon as possible.

6. Cost Sharing Agreement
You bear the direct costs of returning the goods.

7. payment
Payment is made via PayPal.

8. retention of title
All delivered goods remain the property of FRAGILITY.de until full payment. The retention of title also extends to processed items and, in the case of resale, to the purchase price claim (extended retention of title). If the customer is a merchant within the meaning of the German Commercial Code, FRAGILITY.de retains ownership of all delivery items until all payments from the business relationship have been received. The customer is obliged to treat the goods with care until ownership is transferred to him.

9. warranty
The customer's warranty claims are initially limited to a right to rectification or replacement delivery. If improvements or replacement delivery fail, the customer is entitled to a reduction in payment or to withdraw from the contract. Claims for damages remain unaffected. In the event of incorrect operation and improper use of the goods, the customer bears the costs of the rectification or repair.

10. Limitation of Liability
Despite the greatest possible care in the creation of the product range, we unfortunately cannot accept liability for the correctness of the manufacturer's information, product descriptions and price information or for any printing errors, technical changes and the continued ability to deliver all goods. The liability of FRAGILITY is otherwise based on the statutory provisions, unless otherwise specified in these General Terms and Conditions of Business and Delivery. We exclude liability for damage caused by simple negligence, provided that these do not relate to essential contractual obligations, damage from injury to life, limb or health or are affected by guarantees and/or claims under the Product Liability Act. The same applies to breaches of duty by FRAGILTY's vicarious agents.In the event of a breach of essential contractual obligations, liability in cases of simple negligence is limited to the damage that is typically associated with the contract and is foreseeable.

12. dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

13. Place of fulfillment
This contract is exclusively subject to the law of the Federal Republic of Germany.
